Welcome to SLOGR ("Company", "We", "Us", or "Our"). This user agreement ("Terms of Use") is an electronic record in terms of the Information Technology Act, 2000, the Digital Personal Data Protection Act, 2023 ("DPDP Act"), the Consumer Protection Act, 2019, and the applicable rules thereunder. This electronic record is generated by a computer system and does not require any physical or digital signatures.

By accessing, browsing, or using the SLOGR mobile application ("App" or "Platform"), you ("User" or "Data Principal") acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms of Use and our Privacy Policy. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE DO NOT USE THE APP.

1. DEFINITIONS

• "Platform" / "App": Refers to the SLOGR mobile application.
• "Service(s)": Refers to live cricket scores, commentary, news, statistics, public forums, and other features offered by SLOGR.
• "Materials": All information, text, logos, designs, graphics, images, sounds, software, APIs, and data provided on the Platform.
• "User Content": Any comments, feedback, data, links, images, or messages uploaded by Users in chat portals or public forums on the Platform.
• "Data Principal": Any natural person (User) to whom the personal data relates, as defined under the DPDP Act.
• "Child": An individual under the age of 18 years.

2. REGISTRATION AND ACCOUNT SECURITY

• A. Eligibility: You must be at least 18 years old to use this App independently. If you are a Child, you must only use the Platform with the verifiable consent of a parent or legal guardian.
• B. Registration: To personalize your experience or access premium features, you may need to create an account. You agree to provide accurate and complete information.
• C. Security: You are solely responsible for maintaining the confidentiality of your account credentials. We shall not be liable for any loss incurred due to unauthorized use of your account. We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

3. USE OF THE PLATFORM AND INTELLECTUAL PROPERTY

• A. Ownership: All Materials, software, and intellectual property on the Platform are owned by SLOGR or its licensors.
• B. Limited License: We grant you a personal, non-exclusive, non-transferable right to use the Platform strictly for personal, non-commercial purposes.
• C. Restrictions: You expressly agree NOT to:

• Copy, reproduce, republish, distribute, or create derivative works from the Materials.
• Use automated tools, scrapers, robots, or spiders to extract data, live scores, or API responses from the Platform.
• Reverse-engineer or decompile the Platform’s software.
• Replicate Platform features on competing websites or applications.
• Use the Platform for any commercial purpose without our express written consent.

4. PROHIBITED CONDUCT

You agree not to host, display, upload, modify, publish, transmit, update, or share any information that:

• Is grossly harmful, defamatory, obscene, pornographic, pedophilic, hateful, or racially/ethnically objectionable.
• Encourages money laundering, gambling, or violates any law in force.
• Infringes upon any patent, trademark, copyright, or privacy rights.
• Contains software viruses, trojan horses, or code designed to disrupt the Platform.
• Deceives or misleads users or impersonates another person.

5. PUBLIC FORUM AND USER CONTENT

Certain sections of the Platform may feature chat portals or comment sections ("Public Forum").

• User Responsibility: You are entirely responsible for the User Content you post. Do not share personal data of others or post abusive content.
• No Guarantee: We do not guarantee the accuracy or quality of User Content. You may be exposed to objectionable content, and we assume no liability for the same.
• License: By posting User Content, you grant Us a perpetual, royalty-free, worldwide license to use, reproduce, and display such content.
• Moderation: We reserve the right to remove any User Content and terminate accounts that violate these Terms or applicable laws.

6. ADVERTISEMENTS AND THIRD-PARTY LINKS

• Ad Displays: The Platform may display advertisements from third parties. Responsibility for ad compliance with applicable laws rests solely with the advertisers.
• No Liability: Your business dealings with advertisers are solely between you and the advertiser. We do not endorse the products/services advertised and shall not be liable for any loss resulting from such dealings.
• Third-Party Links: Links to external websites are provided for convenience. We have no control over and assume no responsibility for third-party privacy practices or content.

7. SUBSCRIPTIONS, PAYMENTS, AND REFUNDS

If SLOGR offers premium subscriptions (ad-free experience, exclusive content):

• Payments: All fees are payable in advance through authorized third-party payment gateways. You are responsible for all applicable taxes.
• Third-Party Processors: We do not store your payment details. Transactions are governed by the terms of the respective payment gateway. We are not liable for payment processing errors.
• Cancellation & No Refund: You may cancel your subscription at any time; however, cancellations take effect at the end of the current billing cycle. All payments are final, and no refunds will be issued for partially used periods.

8. DATA PROTECTION AND PRIVACY

• DPDP Act Compliance: As a Data Fiduciary, we process your personal data strictly in accordance with the Digital Personal Data Protection Act, 2023, and our Privacy Policy.
• Your Rights: You have the right to access, correct, and erase your data, and to nominate someone to exercise these rights in the event of death/incapacity.

9. DISCLAIMER OF WARRANTIES (CRITICAL FOR SPORTS DATA)

• "As Is" Basis: The Service and Materials are provided on an "as is" and "as available" basis.
• No Accuracy Guarantee: While we make industry-standard efforts to provide real-time scores and statistics, WE DO NOT WARRANT that the Platform will be uninterrupted, error-free, or perfectly accurate. Network delays or API latency may occur.
• Not for Betting: All content, including match statistics and analytics, is provided solely for entertainment, educational, and recreational purposes. We strictly do not endorse or condone illegal betting or gambling. We assume zero liability for any financial losses or damages you may incur based on data presented on the Platform. Actions taken based on our content are entirely at your own risk.

10. LIMITATION OF LIABILITY

To the fullest extent permitted by law, SLOGR, its founder, affiliates, directors, and employees shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages (including loss of profits, data, or goodwill) arising out of:

• Your use or inability to use the Platform;
• Errors, inaccuracies, or delays in live sports data;
• Third-party conduct, unauthorized data access, or cyber-attacks.

In no event shall our maximum aggregate liability to you for all claims exceed the amount paid by you (if any) for accessing the Service in the past 12 months, or INR 500 (Rupees Five Hundred only), whichever is lower.

11. INDEMNITY

You agree to indemnify, defend, and hold harmless SLOGR, its founder, employees, and affiliates from any claim, legal action, loss, or expense (including attorney fees) arising from:

• Your use of the Platform;
• Your breach of these Terms or the Privacy Policy;
• Your violation of any third-party rights or applicable laws (including the DPDP Act).

12. FORCE MAJEURE

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, pandemics, natural disasters, war, riots, server outages, cyber-attacks, or government regulations.

13. MODIFICATION AND TERMINATION

• Modification: We reserve the right to update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the new Terms.
• Termination: We may suspend or terminate your access to the Platform immediately, without notice, for any breach of these Terms (e.g., data scraping, abusive behavior). Your obligations and our disclaimers will survive termination.

14. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Bhiwani, Haryana, India. Furthermore, data protection grievances may be escalated to the Data Protection Board of India.
